JUDr. Gerhard GROSS

Completed his law studies at the Faculty of Law, Comenius University in Bratislava, where also earned Doctor of Laws (JUDr.) degree. During studies, Gerhard gained valuable practical experience at prestigious international firms. After graduating, he began his legal career as an attorney. In 2023, he successfully passed the Bar exam and was admitted to the Slovak Bar Association. Since then, Gerhard has been providing legal services independently. He speaks fluently in Slovak, English, Russian and German.

Remuneration

The attorney’s fee is primarily based on an agreement between the attorney and the client. The client may agree with the attorney on an hourly rate, a fee per action, a flat fee, a fixed fee, or a success fee based on the outcome of the case.

If no agreement can be reached regarding the fee, then the tariff fee established by the Decree of the Ministry of Justice of the Slovak Republic No. 655/2004 Coll. on Attorneys’ Fees and Reimbursements for Providing Legal Services applies. This decree governs the method of determining and the amount of the fee, reimbursement of out-of-pocket expenses, and compensation for the attorney’s time lost in providing legal services to the client.

Tariff Fee

The basic tariff rate is determined according to the tariff value of the case or the type of case, or the right involved, and based on the number of legal service actions performed by the attorney, unless otherwise stipulated by the decree. The basic tariff rate may be reduced or increased in cases specified by the decree.)

Contractual Fee

When entering into a legal services agreement, the attorney and the client may agree on the method and amount of the contractual fee. The contractual fee must not be contrary to public morals.

The contractual fee may be determined as:

Hourly Rate

Based on the number of hours reasonably spent on the case.

Flat Fee

A fixed amount, e.g., monthly.

Percentage Fee

A percentage of the value of the case.

Tariff Fee

An agreed fee different from the basic tariff rate.
